Non-Contract Activity is the term used to refer to an NHS-funded SERVICE delivered to a PATIENT for whom an Integrated Care Board has responsibility, where there is no written NHS SERVICE AGREEMENT in place between the relevant Health Care Provider and that Integrated Care Board.
This is an NHS-funded SERVICE delivered to a PATIENT by a Health Care Provider which does not, at the point at which that SERVICE is delivered, have a written NHS SERVICE AGREEMENT in place with the Integrated Care Board which has responsibility for the PATIENT (as determined under the "Who Pays?" rules published by NHS England, but which does have a written NHS SERVICE AGREEMENT CHANGE for the delivery of that SERVICE in place with at least one other Integrated Care Board.
NHS England's Contract Technical Guidance sets out further details on Non-Contract Activity, including on when a Health Care Provider must or may provide a SERVICE to a PATIENT on a Non-Contract Activity basis.
